BGIPL (“We” or “Us”) provides for a vast online platform wherein which artists and designers from all around the world have an option of displaying their creativity / products/ designs on the website of DelhiGear viz. [www.DelhiGear.com] (“Website”) for sale, without affecting or compromising on their rights over such creativity / design/products. As an entity which deals with innovative products, we understand the importance of respecting the originality of one’s work, its quality, copyright and other intellectual property rights. Irrespective of the fact that you are an artist, customer or a browser, it is essential that adequate respect is given to the intellectual property rights of all the works that are displayed on the Website whether it is being purchased or not.

The Terms set out in this Website may be altered / amended from time to time depending on the policies of BGIPL and the prevailing market conditions. BGIPL requests you to read and understand them as often as possible as it may not be possible for BGIPL to intimate you on every change that occurs in these Terms.

We, through the Website, provide a platform that will enable you to view the contents and products uploaded by various designers (“Products”) across the world and purchase the same directly from such designers without any interruption or involvement from the side of BGIPL. The Website also provides a platform for users to interact with the designers / artists. With the best of intentions, DelhiGear endeavors to push the designs at all avenues that DelhiGear has access to in order to promote the designs including but not limited to other online market places and offline retail channels as the case may be. We request you to note and understand that this Website provides only a Platform for your direct purchase of any Products (designs / pictures of which are uploaded by designers themselves on the Website) from such designers / artists directly and BGIPL do not have any role, responsibility or liability in the transaction entered into between you and the designer.

The Terms and Privacy Policy displayed on the Website, once accepted by you, becomes a legally binding contract between you and Us. CONTENT , COPYRIGHT & INTELLECTUAL PROPERTY POLICIES

You understand that all designs, information, images, pictures, data, text, music, sound, photographs, graphics, video, messages, or other materials submitted, posted, published, displayed, performed, or offered for sale through the BGIPL (“Content”), whether publicly posted or privately transmitted, is protected by copyright and other intellectual property rights. DelhiGear shall always make its best efforts to safeguard the interest and the rights of the designers with regards to their respective artwork.

We request you to note that BGIPL do not prescreen any of the Content or Products that are uploaded on the Website and therefore will not be in a position to examine or evaluate the same inter-alia in terms of its accuracy, usefulness, safety or such other features. BGIPL only provides an online platform for the artists to display their creativity, sell their Products inter-alia on the Website and benefit to the best out of it. In doing so, we request you to be legally compliant as required under applicable laws since we do not check so as to whether they have obtained all required rights to do so.

Further, BGIPL do not own any of the intellectual property rights including copyright over the designs, contents and Products displayed for sale on the Website as the same are completely owned by such designers uploading the same or their assignees. BGIPL only provides a platform that would facilitate the purchase and sale of the Products uploaded by the designers and do not own any content or have any other rights over the same. The user hereby agrees that claim being made in relation to the intellectual property rights of the contents / designs/ Products uploaded on the Website will be made directly against such designers who have uploaded it and BGIPL shall not be responsible or liable in relation to the same.

It shall be the sole discretion of BGIPL to prescreen the design / content / Product uploaded on the Website. However, it is to be noted that BGIPL does not have any obligation to do so. If You believe in good faith that any content or Products made available through the Website infringes upon Your intellectual property rights, You may submit a notice of claimed infringement to us in writing to our designated Intellectual Property Rights Agent at [• ].

GRANT OF RIGHTS & USER CONDUCT

So long as you comply with these Terms, BGIPL hereby grants You a limited, non-exclusive, revocable, non-transferable license, without right of sublicense, to use the BGIPL services solely for their intended purpose as illustrated under these Terms. While using the Website you agree to:

While availing the services offered by BGIPL you agree and accept that We are only providing You a platform to upload the contents / designs / Products uploaded by the designers. We are therefore not responsible or liable for any claim that may arise from You or any third party who has purchased any Products or otherwise, since the agreement for the same is only between You and the designer / artist. It is to be noted that the consideration paid by the You for purchase of the Product uploaded on the Website will be directly be made by to the designer / artist and BGIPL shall have no role to play apart from providing a platform for enabling Your transaction with the designer.

CREDIT CARD DETAILS

You agree, understand and confirm that the credit card details provided by you for availing of services on our Website will be correct and accurate and you shall not use the credit card which is not lawfully owned by you, i.e. in a credit card transaction, you must use your own credit card. You further agree and undertake to provide the correct and valid credit card details when making payment on our Website. We do not be store any information related to your Credit card/ Debit card or net banking. In case we do not receive an authorization from the respective bank or the transaction gets interrupted due to any reason, the transaction will be treated as failed and no order will be processed for that transaction. In this case, if any amount has been deducted from your account, the same will be credited back. We shall not be liable in any event, for any credit card fraud that occurs to you. Our payment partner’s (being the Payment Gateways and facilitators and Banks) and our fraud detection team constantly monitors your account in order to avoid fraudulent accounts and transactions. Users availing discount coupons or vouchers fraudulently shall be liable for legal actions under law and we reserve the right to recover the cost of goods, collection charges and lawyers fees from persons using our Website fraudulently. We reserve the right to initiate legal proceedings against such persons for fraudulent use of our Website and any other unlawful acts or omissions in breach of these terms and conditions. In the event of detection of any fraudulent or declined transaction, prior to initiation of legal actions, we reserve the right to immediately delete such user account(s) and dishonour all past and pending orders without any liability. HOW CAN YOU PLACE AN ORDER?

We ship all over India.

For delivery of products in India order from Delhigear.com (Domestic). This policy is for Indian geo location only, for international policy please check respective website.

ARE THERE ANY SHIPPING CHARGES APPLICABLE ON MY ORDER?

Shipping is free for all Delhi orders above Rs. 10000/-. Others as per weight of the shipment charge is applied to all local orders below Rs. 10000.

Other States delivery Charges are also as Per Volume or Weight Which Ever is Higher.

HOW DOES THE DELIVERY PROCESS WORK?

Once our system processes your order, each product is thoroughly inspected to ensure they are in a perfect condition. After they pass through the final round of quality check, they are packed and handed over to our trusted delivery partners. Our delivery partners then bring the package to you at the earliest possibility. In case, they are unable to reach your provided address or at a suitable time, they will contact you to resolve the issue.

The Local Delivery time is same 1-5 Days.

The National Delivery Takes 2-7 Days Depend on the location.

HOW DO I CHECK THE STATUS OF MY ORDER?

WHAT IS THE ESTIMATED DELIVERY TIME?

Estimated dispatch time of each product is written under the Shipping and Returns tab on the respective product page. Once your order has been dispatched, you will receive an email with the details of the tracking number and the courier company that is handling your order. You can track the status of your package 24-48 hours after your order is dispatched from our warehouse. Estimate time of Delivery is Approx. 2-7 Days from the date of dispatch.

CANCELLATION POLICY

WHAT IS DelhiGear CANCELLATION POLICY?

Cancellation before shipment: If the order or the item(s) that you want to cancel have not been shipped yet, you can write to our customer support team at customercare@DelhiGear.com or Whatsapp us on +91 7065116449 between 9AM and 6PM, Monday to Saturday. In such cases, the order will be cancelled, and the money will be refunded to you within 48-72 business hours after the cancellation request is duly processed by us.

Cancellation post shipment: Please note that we don’t entertain any cancellation requests for orders that have already been shipped.

ARE THERE ANY CANCELLATION CHARGES?

There are zero cancellation charges if the order hasn’t been shipped from our warehouse but if the order has already been shipped we’ll not be able to cancel it.

If you want to cancel or change your order before shipment, you can reach out to us at customercare@DelhiGear.com in order to notify. However, actual shipping charges levied by the courier company will be deducted from the amount paid by you.

ARE ALL PRODUCTS ELIGIBLE FOR CANCELLATION?

The policies for all products are different. Please check the Shipping & Returns tab on the main product page to check if the products are cancellable/returnable or not. HOW CAN I GET REFUND FOR CANCELLED ORDERS AND HOW MUCH TIME DOES THIS PROCESS TAKE?

In case of cancellation before shipment, the refund is processed within 3-4 business days after receiving the cancellation request.

For transactions done through credit/debit cards or net banking, the refund will be processed to the same account from which the payment was made within 48-72 hours. However, it may take 4-5 additional business days for the amount to reflect in your account.

GOVERNING LAW AND JURISDICTION

The seat and place of arbitration shall be at Gurgaon, India and the decision of the Arbitrator shall be final and binding on both parties herein. The language of arbitration proceeding shall be English.

This contract shall be subject to the exclusive jurisdiction of courts in New Delhi, India and shall be governed by the Indian laws.

RETURN, REPLACEMENT AND REFUND POLICY

HOW DO I RETURN AN ITEM PURCHASED ON DelhiGear?

DelhiGear offers its customers an ’Easy return policy’, wherein you can raise a return/exchange request of a product within 7 days of its delivery. We also accept partial returns wherein you can raise a return request for one or all products in your order.

Step 1: In the Support section, through your Profile, enter Issue Type (wherever asked), add Description (accordingly), and submit. Help Desk A prompt showing your Ticket No. will appear on your screen and a mail with the same information will be Emailed to your registered address.

Step 2: The products will be picked up within 4-5 business days. A refund or replacement will be initiated, thereafter. Please note, refunds/replacement will be initiated only if the products are in appropriate* conditions.

For all communication against raised tickets, please check your registered email IDs.

I HAVE RECEIVED A DAMAGED OR DEFECTIVE ITEM/WRONG PRODUCT IN MY ORDER, HOW SHOULD I PROCEED?

Our shipments go through rigorous quality check processes before they leave our warehouse. However in the rare case that your product is damaged during shipment or transit, you can request for a replacement or cancellation and refund. If you have received an item in a damaged/defective condition or have been sent a wrong product, you can follow a few simple steps to initiate your return/refund within 1 days of receiving the order:

Step 1: Contact our Customer Support team via Help Desk within 1 business days of receiving the order. The window for this will open when our delivery partners mark the orders “delivered”. Delayed queries will not be encouraged on the account of the package being opened late.

Step 2: Share images and videos (JPEG only) with us along with your order details and your request to return/replace/refund the defective/wrong items in your order. Our team will assist you as per the policy in which your order was placed.

Step 3: We will pick up the products within 4-5 business days. If the returned products are received in appropriate aforementioned conditions, refund or replacement as requested will be initiated.

Note: If it is a case of replacement, it is subject to the availability of stock. In case that a replacement may not be available, we will suggest you to select a product from the same category for which options will be shared by our team.

CAN I RETURN PART OF MY ORDER?

Yes. A partial return can be created of the whole order depending on their individual return policies, thereby seeking replacement/ refund. However, any product being returned needs to be returned in full including all components as well as any complimentary gifts or products which came along with it.

HOW LONG WOULD IT TAKE ME TO RECEIVE THE REFUND OF THE RETURNED PRODUCT?

Please note, DelhiGear initiates the refund after the returned item has reached us and the quality check is successful. Therefore, the refund initiation time may vary by time taken by the courier partner to deliver the return to a DelhiGear warehouse. In case of any refund discrepancies, DelhiGear may at its sole discretion, request you to share with us a screenshot of your bank statement.

After the refund has been initiated by DelhiGear as per the Returns Policy, the refund amount is expected to reflect in the customer account as per the following timelines:

For payments done through credit/debit cards or net banking,the refund will be processed to the same account from which the payment was made within 24-48 business hours of us receiving the products back. It may take 2-3 additional business days for the amount to reflect in your account.

For cash on delivery transactions,we will initiate a bank transfer against the refund amount against the billing details shared by you. This process will be completed within 24-48 business hours of us receiving the products back and your bank details on email. It will take an additional 2-3 business days for the amount to reflect in your account.

WARRANTY POLICY

WHAT IS DelhiGear’ WARRANTY POLICY ?

We stand behind the quality of our products with a Limited Lifetime Warranty. The warranty is valid for upto six months from the date of purchase. / Warranty timeline of each category and product may vary and is written on the respective product page under the Warranty tab.

WHAT IS COVERED UNDER WARRANTY?

Any and all manufacturing defects in production pertaining to materials or workmanship. Such defects include issues related to bonding, stitching, material or components failure and workmanship. This guarantee applies when the product is used under normal conditions and for the purpose for which the product was designed.

WHAT IS NOT COVERED UNDER WARRANTY ?

DelhiGear warranties do not cover misuse, neglect, accidents, abrasion, solvents, cleaning liquids, damage during transport, or any modification to a DelhiGear item. We also cannot be held responsible for loss, damage or cost resulting from the use or loss of our products. Please note that general wear and tear, including but not limited to the breakdown of colors and materials over time, is not considered a material or manufacturing defect and is therefore not covered by our warranties.

We will not honor fake or fraudulent warranty claims and reserve the right, in our sole discretion, to reject any warranty claims which we suspect to be fraudulent (including intentional damage to products, duplicate claims, and counterfeit products).

HOW TO FILE A WARRANTY CLAIM?

If you think your product has a manufacturing defect, you can submit your warranty claim. To file a warranty claim, raise a ticket for that product from Help Desk and our team will further assist you with the procedures. We will try our best to provide you with a suitable resolution as per the criteria.
